Two TNs

My friend worked for company A with TN status which expires at 2021 (I-797 approval notice). Later on, she left company A and worked for company B with TN status which expires at 2022 (I-797 approval notice).

Recently, the contract job with company B is coming to the end. And company A found a new job for her.

My question is:
Can my friend work for company A since company A's TN status will expire at 2021? OR she needs to apply new TN status.

Thanks!

It would be safer to get a new TN, since her relationship with Company A had ended. If she had merely been "benched" or laid-off temporarily at A, and her TN had been written without a specific client to work for then her TN would still be valid.
It would also depend on whether, when she got the 2nd TN, if it was for "new concurrent employment" (which does not kill any old TNs) or if it was for "new employment" - which essentially cancelled her old TN.

Hi Nelsona,

1) If it is for "new concurrent employment" (which does not kill the old TN), does she/he need to provide the documents from the OLD EMPLOYER to USCIS to proof that the old employer is still hiring her/him even if she/he is "benched" or laid-off temporarily (no recent pay slips)? OR USCIS needs some documents from the OLD EMPLOYER to support?
2) If it is for "new employer", will the old TN be killed from USCIS system when applying for 2nd TN?

Thanks!

As I said, the safer course is to make new petition. She would need to first have her I-129 for B. It will decide if she can even use the old TN.

If she was benched, she would already have proof of this in her possession when she was let go or left.
That is all I will say on the matter.
