Two I-140s approved for Consular Processing

Hi Everyone,

I have a question on consular processing. My lawyer had filed
two I-140s for me, one in the EB2 category and the other in
the EB3 category. The EB2 category I-140 was approved on
April 1st 2003. Since I had applied for Consular Processing, BCIS
forwarded the I-140 petition to NVC and consular processing
on my case commenced. Towards the end of June 2003, after
I had paid the fees for consular processing and mailed in Packet
3 to the NVC, I received a notice from the NVC stating that my
I-140 petition was sent back to BCIS since they requested it back.
I later found out the recall was due to the other I-140 petition
that my lawyer had filed.

The other I-140 ( EB3 category ) was approved on August 4th,
2003 and is now being forwarded to NVC. I have been trying
for the past two months to have the first petition returned to
NVC so that Consular Processing on my case can continue.

Now that the other petition(EB3 category) has been approved
and has been forwarded to the NVC I am not sure what I should
do. Should I just leave things as they are and hope that
Consular Processing will continue without any problem or is
there some action that I should take in this matter ? Is there
someone out there who has had two I-140 petitions filed who
could explain on the way things will turn out ?

I would greatly appreciate it if anyone with experience in this
matter would advice me on this subject.

This is a unique case hence you have not received a reply. I'd suggest consult with your attorneys or consult with Mr Rajiv Khanna/ his team of attorneys and they should be able to give you the best answer. Once you have the answer do share it with us so that immigrationforum members like us are aware of "what to do" in such situations.

I got my i140 approved on aug 10th. I have also opted for CP & its Mumbai consulate for me. How about you? Lets keep in touch...
