I have a H1B from a research institue A (exempted from cap) and also have visa stamping in the passport for that which is valid till Nov 2007. I have applied for a new H1B under FY2007 quota through a commercial company B which would start from Oct 1st 2006 but I would be joining B from January 2007. I know that once I resign from A and join B, I will have to go for stamping again because this new H1B is not a transfer but a new petition which falls under cap. My question is can I travel to India in Dec 2006 and come back using the visa stamping of A and then join B? Would the H1B petition for B be still valid if I enter US using H1 petition of A?
