Two H visas at the same time while doing waiver

I am sorry if somebody has asked this before, I searched and could not find a similar situation. Here is the situation:

1. I am US citizen

2. My wife is on J visa but she will get her waiver through the VA Hospitals

3. VA is affiliated with the University, and the University hospital (UH) also wants my wife to work part time there, at UH. They want my wife to be 7/8 or 6/8 at the VA and 1/8 or 2/8 at the UH. They of course, will pay her for that

My question is: Is this legal and or possible? Would this jeopardize her waiver? Would she have to obtain separate H visa from UH and if yes, how can that be, can somebody obtain second H visa while doing a waver?

To answer your question, yes, it is illegal to work at UH without authorization.

Yes, you can have as many H1s as you want and this will not jeopardize the waiver as long as she works full time at the waiver position, i.e. 40 hrs per week.

I believe the VA gives sponsorship as long as the position is 5/8
VA rules tend to be different from other areas.

Thanks for the response. 8/8 (pronounced eight eights) is just the designation of the percentage of your work. The VA definition for full time position is 8/8. Anything less has to be quantified in terms of "eights". For instance, 50% part time job at the VA would be 4/8ths. I think the reason why they use "eights" is because the full working week has 40 hours, so they had to come with a number that 40 hours can be diveded with. If they come with 7ths (because there are 7 days in the week) than they can not divide the hours in the week by 7. Anyhow, 1/8 would translate into 5 hours, and if UH wants her 1/8 than VA would allow only for 5 hours a week outside the VA.

Paskal is right when saying that VA has its own guidelines. They will NOT give a waver if one is less than 6/8ths we were told, which is at least 30 hours at the VA a week.


So let me than summarize: My wife can work at the UH, but UH has to apply for an H visa than? The H visa from the VA would not count. And this can be done despite the fact that UH is not a waver position. Thanks a lot.

in order to get J1 waiver through VA hospital (or any other emploeyr for that matter) physician must work 40 hours per week at waiver facility/ies. If VA hospital issued a letter saying she fulfilled 40 hour per week obligation for 3years ( regardless what and where she works), that should be sufficient. Sharing my experience.
