Hi,

My friend just got an offer from company B.
He is planning to do this: Let company B file
the H-1 transfer petition. After he got the reciept , he will take his paid vacation from Company A while at the same time working for Company B (Two reasons for doing this: first, he don't want to quit until his H-1 transfer is done; second, he don't want to waste his accrued vacation days if there is no-way to cash it out) . Is that legal? Does anyone know what the risk is? His current employer, i.e. company A is in a totally different business from his new employer company B.
Really appreciate your opinion on this issue.

Have a nice day

Yes. But once he starts to work for B, he cannot go and attend work for A. He has to serve the termination notice before or on the first day of reporting to duty. Hopefully the H1 transfer is on fast track.

Does "serve the termination notice" means that he can't start to work for B while taking vacation from A? or in short, it's ILLEGAL to be in status as an H-1 employee for two companies at the same time??

Thanks.
