Two Green Cards!!! What to do?

My husband and I have applied for Green Card through the DV lottery process and through I-140/I-485 (EB1).

We got the DV Lottery I-551 stamps in our passports in the US consulate on the 26th of september :) and entered the US as Permanent Residents the same day (26th of september) :D.
Then, I have checked my AOS case online the next day 27th as soon as I got home. Imagine what I found: Unbelievable- Our I-485 AOS were approved by INS on the 27th and the notices were mailed to us. This means that the approval took place one day after our entry to the US...

Questions:

1. What must we do?
2. How can we stop (revoke) the AOS process?
3. When is it good time to do it: Now or until we receive the plastic cards in our hands?
3. New Alien Numbers were assigned to us by the consulate although we have told them about our A numbers in INS. Is this a problem or INS can sort it out?
4. What forms should we file to cancel the AOS process?

Please, help! I know that nobody can have two Green Cards!

Thanks,

Roberta

Call the USCIS and inform immediately before 2 green cards may get you one Red card.

(Just kidding about the color. couldn't resist)

Wait for one of the GC to actually arrive in the mail, then call the USCIS and cancel the other. You want one of the GCs in person before cancelling so the USCIS does not accidentally cancel both GCs, and you end up with neither.

Idhar ek bhi nahin hai ye log do leke baithe hain

hahaha!
put it up on EBAY! lol

just kidding

Two green cards: here is the solution to my "problem"...

Thanks to those of you who were serious in trying to answer to my questions. I am from Canada and my husband is from Egypt. We got our I-551 in our passports (through the DV Lottery process) and the next day our 485/EB1 green cards were approved. The day after that they ordered GCs and will mail them.

So, I called USCIS: they said it is not big problem and that it happens sometimes (very rarely but it happens).

What we MUST to do is the following:

1. Get the two plastic cards for each one of us and return the ones with the latest dates of approval (so the countdown for US citizenship will be according to the earliest one).

2. Also we need to send an explanation letter: we have to state in it the story and mention that these two GCs are under two different Alien numbers so the USCIS will join each one's file under one A# (The alien number of the earliest approved GC).

Important: every one of us must do it separately.

Thanks All for your help.

TH4GC:

CIS did nothing wrong in this case. They approved an EB1 applicant and her dependent. That's all.

On the other hand, The DV Lottery is run by the Department of State (not USCIS). Moreover, the fact of returning back the last approved GCs ( in this case I guess these will be the EB1 GCs) opens the way for two other people to enjoy the benefit of having GC through EB1 category...

So, TH4GC, you need to make sure you can qualify for an EB1 category and apply for it. I am sure you will get; don't delay. The system is fair. It's my experience....

Is Canada on the DV Lottery Program?
DV is by country of birth, not by country of residence. She was born in Egypt, so she qualifies for DV, and she can have her DV interview in her country of residence.

That was a joke

That was a joke. I am EB1 filer and in 485 stage and from nonretro country.

Good Luck to you all. Great Forum!

TH4GC and others,

Yes that's right: my country of birth is Egypt and I am Canadian. I can still apply for the DV Lottery.

I wish you all from my deep heart the best of the best in your GC process. I am very satisfied with the process and I hope your one will be adjudicated soon.

Good Luck!

Roberta
