Two different DS2019 with different HRR requirements

Hi,


I have been on a J1 visa for almost four years now, always in the same program and conditions. I have been through re-stamping two or three times. In the last stamp (and DS2019) you can read that I'm not subject to the HRR but I checked a previous one and I was subject to HRR. My program hasn't changed and the funny thing is that the person at the embassy in these two cases is the same. Do you think I'm subject to the HRR or not?

My two cents for you Juan,

I was in a similar case (this was back on 2000), I spent 3 years in the my program, re-stamped 2 times and only on my first stamp stated that I was subjected to the 2 YHRR, I wondered if they could have made a mistake and I was going to be able to get away with it, It turned out I was subject, I had always been and truly the fact that the following stamps didn't say anything about the 2YHRR applying really didn't matter. On my original (IAP-66), I believe the name has change now, it stated that I was subject, the reason being that a Federal Agency of my Government funded my degree in the US.

Where did the money for your degree come from? Your government?, Fullbright program?, usually those fundings are subject to the 2YHRR.

Are you a in Medical School, I believe also med students are require to go back home.

My takeaway here if that if you have a stamp with the 2YHRR stated in there you are SUBJECT TO IT, no matter what the rest of them say, but the usual disclaimer applies here, if still in doubt seek professional help, this things tend to be complicaded and it is always wise to contact the professionals.

If everything fails you can always go home for 2 years and comply...
 
Thanks for the comments. In the end I talked to a lawyer and he couldn't figure it out. So I'm asking for an advisory opinion to the Department of State. If you go to

you can fill the forms online but you still have to print them and send them by mail. They are suppouse to replay en several weeks.

I hope this was a mistake. I have seven documents (between DS2019s and IP96s) and only in one of them it is said that I'm subject to the 2 HRR.

I work for a university so my money is not coming from a goverment...

Let's wait and I see
