Before I filed for AOS based on being a spouse of a US citizen last month, I filed an AOS in 2003, concurrently filed with an Employment-based petition (I-140). I was on H1B then, however, the I-140 was denied because of the sponsoring company's inability to pay (the required salary). It was denied in 2005. Since the I-140 was denied, the I-485 was also denied.
That first AOS filed in 2003 gave me an Alien number, which was also printed on the EAD. I never used the EAD to work for another company because I continued working for my H1 sponsor.
When I filled out I-485 as the spouse of a USC last month, I didn't write down my old A# thinking that it is "invalid" because that I-485/AOS was eventually denied. When I received the Notice of Action for my recent AOS application as spouse of a USC, a new A number has been issued to me.
Please note that when I applied for EAD (I-765) last month, I submitted a photocopy of my old EAD (which were never used) that has my old A#. The form requires that applicant send previous EADs issued.
I didn't think this would be an issue, but I'm re-thinking the whole thing. What do you all think?
