My niece is going to Toronto (with her parents) for getting her H4 stamped.
She is 5 yrs old. Here is the history..
>She came to US on a J2 visa four years ago.
>My brother got a H1 through his employer in 2002, and at different times, both my brother and his wife (on H4) got their visas stamped at the American Embassy in India.
>My niece received her H4 approval in second half of 2002 (along with rest of the family), and her J2 expired last year. (I guess this will be considered 'legal stay' as she has an approved I-797)
>This would be a conversion from J2 to H4 status for her.
Is it safe for her to go to US Embassy in Toronto to get H4 stamped? Or will the Toronto office reject the application for stamping as this will be a change in visa type (J to H)?
