Folks,
I neeed to go to Canada for one day business trip by air.
I have AP on hand.
My question is as follow:
I understand that with AP I can get back to US with no problem. But what happens to my old I94,
should I give it to the airline or just keep it myself? On the way back, do I get a new I94?

Your input is appreciated!

My detail:
RD: 08/99
ND: 09/06/99
FP 08/00

What is your guys opinion that how long I may have to wait to get my i485 approved?

Thanks!

If you go by air, they make take ur I-94 at the US airport of departure for sure. No problem. Make sure you fill out a NEW i-94 UPON ARRIVAL INTO THE USA from canada. The same procedure if you were going to India on AP and coming back. Also, make sure you take ur EAD with u too just in case they ask for it.

You ND is 9/99, should be at least a good 2 months for your approval (my feeling)

Try not to give your I-94. Just don\'t show it to the people, tell them you must have left it at home or so. If you fly back they should give you a new one. I drove there so I did not have any problems.

Good Luck

no nandit...mangobaby is right. I-94 will have to be replaced at the port of entry. should have no problem. the more important paper is the AP. I-94 should be surrendered before leaving the US via aircraft.the more problem will occur if u try to hide it. just be honest cuz you\'re not doing anything wrong...

Can you drive instead of flying i.e., are you close enough to the city you are going? Second question why do you care if I94 is taken away. It will not affect your 485 process.

First of all I dont think the airline takes away
ur I-94, u will have immigration on the way back
on the Canadian side. I believe if u have AP, they
ask u to go into another office on the airport itself
as they have to means on the immigration counters to
verify ur AP, so give urself plenty of time, as it takes
about 15 to 20 mins, for example if u are flying out of
Toronto on a Monday morning or I guess any other morning
too, there are a lot of flights and a lot of people to
coming to the US. I dont know, if they pull out ur I-94
when u show the AP, I am sure when u show ur H-1B, they
do not take ur I-94, u still have the old I-94.
Driving, may or may not help as u are trying ur luck,
sometimes they dont even try to look at ur passport,
but sometimes they check ur visa etc, i have had quite
bit of experience crossing the border as I have done it
about 14 to 15 times, whilst driving, but so far always
on an H-1. I can ask one of my friends who has traveled
on an AP and see what he has to say. Hope this helps
