Travelling with RTD ON ASYLUM STATUS

My asylum was approved in feb. 2006, last month I applied for RTD

So my first question Is there is any risk when traveling to a south American country for 5 days trip and coming back to usa with RTD, since I hear that RTD does not grantee entry to us port and we have to undergo inspection by an IO in the airport.

second is there any problem since I applied for RTD before 1 year since my asylum was approved but I am planning to travel after I have been 1 year on my asylum status

You can travel with no problems. When you enter back to U.S, the officer will issue you a new I-94. Make sure you do not give your old I-94 to any airline people. Keep it home or in your pocket but do not give it to the airline reps.

As to when you enter U.S, the officer will ask you where you went etc and how long for. Ofcourse you can't go to your country of persecution(COP) since you are still an asylee.
 
Thank you for replying.. But what about this new I-94 is going to be dated with a new date or it will be dated by the day I got my asylum approved as my old I-94

I-94 is just a formality. You were granted asylum on the date it says on your asylum approval. They will issue you a new I-94 with the date you enter until "indefinite"

As to your 2nd question, your asylum was approved in feb 2006 right? So feb 2007, you can apply for your GC. When are you planning to travel? You are ok. Make sure you apply for your GC before you go...

I beg to differ a bit. As an asylee, you can travel to your COP for a VERY good reason (i.e. visiting a sick relative) but it is highly recommended that you don't do that. It MAY impact you negatively in the future when applying for a green card, another RTD and citizenship but I do not believe there is a law that precludes one from going back to COP as an asylee if there are compelling, extreme circumstances.

You may be right but I would not give that advise to anyone that it "MAY" be ok.

When you are an asylee and admitted into the country, the job of the officer is to make sure you are still an asylee...i.e, you have not visited your COP. Just like the officer makes sure that a GC holder is still a permanent resident. or an H-1 is still employed with the same company or L1 is being transfered to the company he/she said so OR the person marrying a USC is going to marry them in 90 days by law...

In the secondary inspection room, every asylee is asked if they have visited their COP. If you say YES and you are an asylee, it is up to the discretion of the officer to recommend to the USCIS to remove your asylee status.

Asylee status is black and white. Either you are afraid or you are not. Compelling reasons to visit COP? May be but then you are opening a can of worms.

PR once you were an asylee is a different ball game and has shades of grey. If you come through the port of entry, the officers are trained to look at ur status and determine whether you are still entitled to that status..be it asylee, refugee, PR, B-1/B2, H1, any immigrant visa.

It would be plain silly to know the rules and think it "may" be ok.

I read a lot of usefull information about this documents so thanks a lot, but I have couple more question so if you can help me please.
My case was granted summer 2006 and I received my RTD I wanna travel to Ukraine which is not my COP to meet with my family, but the thing that worries me is that even though I came to US legally I didn't file for asylim for 7 month do you think it will have any negative effect when I try to reenter US with my RTD or it doesn't metter. And also I wanna know if it's best wait a year to file for GC before leaving with RTD and does this travel will have any effect on familly petition case thats pending.

I don't really think it matters if you applied for GC or not since you have your travel document which makes you admisable to US, and your illegal time gets waved once your asylum status is granted. So you should be fine. Please share your experience when you are back ;)

Actualy even after & month I still was legal I had one year visa. can you clearefy for me I-485, is thats the one you fill out for GC? Maybe sounds silly that I dont know but I have great lawer so he does everything and I'm not to familiar with forms and laws.

Yes. Form I-485 is for GC.
