Hi Guys,
This is the situation I am in:

- My lawyer filed for me (H1-B) and my wife(H4) 7th year extension last week (completed 6 years on Feb'24th).

If we plan to travel to India later this year, what should I make sure that we have so we can come back?

As I understand from reading different posts we need to have the approved extension papers and also Stamping done?

Is the stamping done only in St Louis? Also how long does that take?

Any other suggestions in this regard will also be apreciated.

Thanks:confused:

Approved extension papers and also Stamping done
Or H1 and H4 revalidated from DOS in US after you get approval notices

*** if you both have valid AP approved before deparure from US you can use that also

hi waitingforgc04,

Just wondering one thing though, you mentioned your attorney filed it last week, was it filed after your h1 expired or before? I think there's a hard and fast rule in terms of filing. You have to file your extension probably 45 days earliert than your h1 expires. Pls check this out with your attorney. And absolutely pls DO NOT TRAVEL WITHOUT AN APPROVAL notice..thanks

You have to file your extension probably 45 days earlier than your h1 expires.

----- No 45 days law or rule, one can file H1 extension 6 months advance of I-94 expiry date or H1 expiry date OR any day before H1 orI-94 expires. The extension papers should reach USCIS before the I-94 expiry date.

Well, my H1-B was to expire on 24th Feb and the lawyer sent the papers on 20th Feb.

However, when I went to check the status, with the 13 digit EAC... number it says the papers were recieved on the 26th Feb.

Should this be a problem or since as the lawyer says she has a reciept that she mailed it on the 20th, it should be fine.

Thanks

7th Year Ext

Hi Guys,
My 6th Year limit will expire in Early October, 2004 but my LCA 1 year limit will be in Early August, 2004. My question is that Can I apply my 7th Year extension in 2nd week of August, 2004 OR I have to wait till my I94 expiry date comes close? Please advise.

Thank you
