Travelling to India

Hi,

My wife is planning to travel to India and her H4 visa expiring on October 3rd 2005. She is planning to return on 25th September 2005. Has anyone come across any problems in the port of entry just before expiring the visa ?

Any suggestions appreciated.

No problem. She should carry her original H4 approval document and a copy of your latest h1 approval document.

One more clarification, my wife doesn't have H4 from my current employer as tranferred my H1 to new employer beginning this year. Would that be a problem at POE if she doesn't have H4 from my current employer but her H4 visa is valid until October 3rd from my previous employer.

Any suggestions are appreciated.

----------- she can come by valid H4 visa stamp it does not matter if it is from A or B
when she enter US POE she need to show her passport Visa stamp AND your H1 approval notice so that she can get new I-94 till YOUR new H1 approval validity date. if the officer gives her new I-94 till October 3rd 2005 then she should point out to officer or ask for supervisor. if she is is still given I-94 till 3rd October and officer does mistake file her H4 extension with form I-539 BEFORE 3rd October(USCIS must get the extension filing Before Her I-94 expires)
