Travelling to India before filing H1

Hi,

I am in India right now and getting my H1 processed from a company in ths US.I came here on H4.My husband will be coming in may when we'll get the stamping done as he has changed employer.
My question is will there be a problem for me getting the H1 approved since the I94 on my application was taken from me at port of exit and is no longer valid.Also when my h4 stamping will be done my H1 application will already be in the system.I m planning to go back in mid may.What are the options available for me since i m already in india and going back before 31st march is not possible for me??
I m any a big fix right now.Any suggestions??
 
The worst scenario your H1 will come as a new one not a change of status from h4 to H1. Inorder to start working with your approved H1, you have to go out of USA and get your H1B stamped before starting your job. Present H4 stamping is not going to affect your H1.
