I have an H1B visa that expires on Jan 29th, 2004. An extension has already been filed with the BCIS.
I will be taking a trip outside the US in end Dec/Jan and returning around Jan 25th which is a few days prior to the expiration of my current H visa.
My company's lawyers seem to indicate that its okay since I will be returning on a valid visa even though there are only a few days left on it and so to speak my H1 expires within a short time. I shall also be carrying a copy of the H1B extension filing in case of any questions. But just to be safe, I was wondering if anyone has been in this situation before and if so, do you have any comments/suggestions about it ??
The lawyers also seemed to indicate that even though the extension hasnt been approved yet, filing an extension automatically grants an individual 240 valid work days...does anybody have any info on this ?
