Traveling with AP without I140 Approved

Hi Everyone,

I have for I140/485 concurrently, I need to travel as soon as I get my AP.

Note: I am on H1B, however my Visa is single entry and I can not come back to the states using my Visa due to security clearance.

I wanted to know the risk of travelling with AP withoout having I140 approved, Some people do not recommend it.

I have the same question. I am wondering if I can travel with AP (I am in H-1 now) and come back without having new visa stamp in my passport (my F1-visa stamp expired). Please help.

I have applied in EB2-NIW (140/485 pending)
 
You should be able to re-enter the US with your AP and then continue to work with your H1B (as long you don't use your EAD card). Check the AP and I-485 forums.
 
The AP is tied to your I-485. As long thats pending the AP is valid. If the I-140 gets rejected the I-485 gets rejected as well and you will have to get a new H1B stamp to re-enter, but otherwise you should be fine.
 
I have a question in this regard:
Is it ok if you leave USA for 2 years while your I140 and I485 is pending?
Is having AP sufficient? Hwo long dose it take to get your AP approved?
