I am outside the country since Feb 09 due to personal situation. I came back to US to apply my N-400 in May and left US. I will be coming to US do FP in Jun.

I have no lease on my name (gave my friends address). I have following for this address

DL
SSN statement
Bank Statement
CC statement

Let me know if I need additional documents.

Thanks in advance

Prior to Feb 09, I used to live in an apartment from 2005 which I had lease agreement on my wife and my name. Unfortunately, I shred lease agreement and utility bills for that period but I am planning to request the leasing office to fax my lease agreement.

So you lived in the apartment up until Feb 09, then left the US, came back in May 09 to apply and left US again?

That's correct. I have paystubs until Apr 09 to prove that I was employed but not after that. I ended up staying outside due to tragedy in the family. Once the dust settles I will be back.

Since you moved out of apartment and left US in Feb 09 and you didn't reestablish the required 3 month district residency ties before you applied in May, (providing a friend's address is not considered establishing district residency ties unless you actually live with them), they might question your eligibility.

Bobsmyth, thanks for your quick response. I officially changed my address to my friends place at post office and with all other agencies like banks, credit card companies. Is it still not considered as district residency.

From a mailing address perspective it is a change, but from a physical address it isn't since you're not living with your friend. This might raise a red flag at interview since you left US right after you moved out of apartment and never fully reestablished a physical address in US after you left in Feb 09.

So what's the worst case scenario. They deny?

Correct. Denial based on not meeting 3 month district residency requirement. It will l depend on IO at interview and if they catch the discrepancy. Is your friends address in the same area as apartment?

Unfortunately not. It is in a different state.

Thanks for your clarification. Hope everything goes well.

Just be prepared for the IO to ask if you actually moved in with your friend before you left. Also, did you file AR-11 address change and did you file under the state of your friend's address?
