Traveling on H1 with I-485 pending without AP

Hi
I am on H1 visa from last 4 years. I applied in EB1in jan 2005. My I-140 was approved however, I-485 is pending due to Name check and now Retrogression:mad: I am planning to travel on H1-B (India). Is it safe to travel on H1 B without AP? I do need to get H1 stamp on my pasport. Please Advise.

If your visa won't expire by the time you return from india, you don't need stamp. Travelling on visa is always better than AP.
 
Thanks for the information but my H 1B was extended after 3 years and its not stamped.

If your visa is expired you need to get a new stamp in the US consulate in India.

Only if you are travelling less than 30 days to contigous territory (US or Canada) you can re-enter the US with your expired H1-B visa stampa and the I94 that comes attached at the bottom of your extension receipt (I797 I believe)
