Hi all,

Can any one share experience when coming back from India or Pakistan using Canadian passport and also show them AP.

Question: If I don't show them AP and just enter would they give me I-94 with B1/B2 status?

I recently became Canadian citizen and never use my passport but few months ago when I was coming back from Canada using AP; they gave me I-94 with parole status. I use my original passport.

Anyone?

Thanks and praying for all of us.

I travel on a Canadian passport, but I don't think that changes anything for entering the US. Canadian passport isn't any better than any other.
I now use my AP whenever re-entering the US. My lawyer strongly advised entering only with AP and not with my L1-A.

I also enter with CDN passport and AP. It can be any passport, not necessarily CDN. You can only enter up to the date on your AP, and you are only lawfully present up to the date on your I-94 card. My old I-94 had no expiry date (it said "indefinitely"), but now on AP number 2, I am only allowed to stay for one year from my last entry as evidenced by my I-94 card.

Well, dont know y they stamp 1 yr when u enter using AP - may be the BCIS thinks 485 will be approved in 1 yr.

But, when u have applied for AOS - u are in legal status - even if ur I-94 has expired.

Because Canadian are not exempt anymore and used to have unlimited Entry on the I-94. This rule changed lately.

If you've been given an I-94, you always had to leave by the date specified, Canadian or not. What is special about being a Canadian citizen is that you can enter in B status and NOT get an I-94. I entered the US about 50 times before receiving my first I-94.

Please note that if you are maintaining your H-1B status, a Canadian passport has a HUGE advantage - you NEVER need a passport visa (with the whole consular interview crap) if you are entering the US. Just show your I-797 Approval Notice and you're in.

The Real Canadian

how would you enter on B status and have I-485 pending at the sametime, isn't that override your status to visitor?.

Note: I am not on H1B anymore.

Please explain.
