Travel without AP and planning to get H1 stamp

Hi All,

Need your opinion on following -

I just received my labor certification from SF DOL (finally :)) and planning to file 485 / 140 concurrent along with EAD and AP. I need to travel to India in Jan'05 for couple of weeks. Most probably by then I will not have AP cleared, hence I am planning to get H1 stamped (H1 stamp on my passport has expired but I have valid I797 till Jan'06) in India and come back to US on re-newed H1.

I would appreciate your opinion on Degree of risk in the above plan. Will it be advisable to wait for AP ?

I am planning to do exactly the same thing and I have not heard any problems as such. Please let us know what you find out.

Hi Kman75,

Sure, will let you know if I find something on this approach. Just worried about -

1. Freaky scnerio of 485 getting approved in 2-3 months (after I leave US and before getting H1 stamped).

2. Risk in security clearence for H1 stamp
