Travel with valid visa after H1-B extention is filed with same employer

Hi,

I have filed for H1-B extention with existing employer. I have valid visa for another 3 months. I am planning to travel outside of US for a month. After my return date, i still have one month valid visa stamp.

So, can i travel when my H1 extention application is pending. I have heard that it is not safe to travel when H1-B extension is pending.

I understand that we can not travel if we do not have valid visa. But is there any rule that we can not travel even if we have valid multiple entry visa ?

If we can not travel, should i apply for premium processing ? Do we have to go with lawyers for filing premium processing or can i do it myself ?

Please advice.

Thanks for your time.

-------- You can go out and return with valid Visa stamp
So, can I travel when my H1 extension application is pending? I have heard that it is not safe to travel when H1-B extension is pending.
------ If the application for extension is approved once you are back then no problem the new I-94 extended with H1 extension approval notice will govern, if you are out of US when your H1 is approved by BCIS better get the H1 approval notice in home country and show the approval notice with Passport Visa stamp that way you will get the I-94 at POE till your H1 extension approval is extended. Only Chagnge of status is abandoned Not the Extension in same status if you go out of US
I understand that we cannot travel if we do not have valid visa. But is there any rule that we cannot travel even if we have valid multiple entry visa?
---- You CAN travel with valid visa stamp and be back before visa stamp expires, better keep the H1 extension filling receipt with you show only if asked
If we cannot travel, should I apply for premium processing? Do we have to go with lawyers for filing premium processing or can I do it myself?
---- You can apply directly or through lawyer for premium processing, attach the H1 extension filing receipt, pay the BCIS fees, fill up the form to request PP and send it to correct address with return receipt mail

I have come to know this from one of lawyers :

If you have a current pending case with immigration for an H1 extension, you may not travel or else your petition will be considered abandoned.

Is the above statement true? Please reply. It is a very important decision for me.
