Travel with expired TN & pending app.

Hi everyone,

I've been scouring the board looking for something that is exactly similar to my current situation...but cannot find exactly what I am looking for. I am a Canadian, and my current TN status expires on Dec. 5th, 2006, and I have applied for a renewal. Obviously it is extremely slow-going (VSC received on August 22, 2006, but they are processing April's applications at the moment), and I received the "receipt" from USCIS. My question is: I would like to travel home to Canada for the holidays (Christmas), from December 20th to 30th, to see family and friends I wouldn't get to see any other time of year. Can I (in theory), leave the US on 12/20/06 (15 days after my current TN expires), and return back from Canada on 12/30/06 through the Halifax International Airport (which apparently now has TN processing abilities...yay!), apply for yet another TN on the spot with supporting paperwork, and be good to go back to work for the new year? Is it frowned upon to apply for a new TN at a POE when I have one pending approval?

I know this is a long post...and I truly appreciate any help anyone could offer with my numerous questions!! :eek:

Keep your receipt from the INS as a proof to show that you applied for your new TN before the expiry of your current TN.

You should be okay to apply for a new TN at the airport while the renewal is pending...

I definitely planned to bring my receipt with me during my travel...it's basically the only thing I have once Dec 6th rolls around! Now, if I chose to NOT apply for a TN permit at Halifax Intl Airport, would they (USCIS) simply let me back in the US with the pending application? Or is it a foregone fact that I would need to apply for a new TN on the spot?

I appreciate the quick response bigboy00; I'm the first Canadian to work at my agency, so my employer is of little help with my questions.

-- No, you will NOT be allowed to enter the US using your "pending TN" renewal and the expired TN (current). You will have to reapply at the border/Airport-PFI.

Okay, perfect. That is exactly what I needed to know. I'll leave for vacation, bring my paperwork, and re-apply upon re-entry (and pray of course). If they decide to deny me, I hope they'll be nice and let me back in to at least get my car and household items :rolleyes:

Lastly,

Once you are granted a new TN at the airport you must write Vermont and ask that they cancel your extension.
