Travel with current AP while new AP is in process

Hi Guys,

I am planning to use the current AP that expires on Jan 2007. Meanwhile, my lawyer have filed for new EAD/AP on Sep 15th (TSC). EAD got approved within two weeks.

Since new AP is inprocess, can I travel with old AP that expire on Jan 2007? Will there be any problem?

My lawyer adviced me not take any risk and asked me to travel after the new AP is approved. Lawyer says I can even use old AP even after new AP is approved. But I have to travel within a week.

please change your lawyer. That is not true. You can use your current AP while it is valid. it has nothing to do with new AP.

When lawyer apply for the new AP, Shouldn't be the start date a current date? If this is the case, when the new AP gets reject, Should the current one automatically get rejected?

in a way if they reject your AP......for some reason....that reason will hold true for all AP.......hence we can say that your old AP becomes void..........but another argument is that the old AP is also valid since it was issued by uscis for the period......hence you are not doing anything illegal by using the old AP since its still a valid document unless uscis informs you that it is cancelled before you travel.....
 
I had no issue when entering JFK. They just asked a question for formality. Meanwhile my new AP was approved on Nov 1st when I was out of country and received the actual doc recently. Will this AP can be used for next trip as this was approved when I was away from this country?
