travel with AP

Hi Gurus, is there any problem with traveling on AP for longer time, like 10 month ? My wife wants to come back to home and come back later.

She can come until a day before expiry of AP.

My layer put on the application in "suggested length of travel" 30 days, thats why I wasn't sure, besides on INS side is written that it should be emergancy trip only, I hope that they don't check the reasons so much during arrivel.

Then why do they give out Ap valid for a year? Before the work load were huge (especially for family based immigrants) where interview was mandatory, if an applicant was using AP the 485 processing was suspended until the applicant comes back.

With majority of the employment based approvals based on I140 and other documentation and long drawn approval process, they do not stop 485 processing just because somebody used AP.

Some lawyers always want to give you a cautionary answer, even if you ask them can I cross the road?

I hope what you are saying still mean that my wife will have no problem with coming back after 10 months...
