travel with AP but no EAD, is it safe

If you have not received EAD yet, that means you have some
kind of visa (H1B or L1). If that is true, why do you need
to travel with AP in the first place.

In other words, if you are legal in the country, and have not
received the EAD card, do not use AP; use your H1/L1 instead
to enter the country.

On the other hand, if your visa has expired and you don\'t have
the EAD card yet, why would you want to travel out of the
country and be in trouble??

No You should not

once you use your AP, you will under status “pending adjustment of status applicant" in other terms you will loose your earlier status(like H1). So after coming back you need to have EAD to work legally. Hope this helps

A person under H-1 status can travel using AP and there is no need for EAD. Both of my attorneys (one for I-485 and one for H-1) confirmed that with me. My H-1 lawyer also sent me an INS memo dated 5/16/00 which clearly stated so.

If you have a valod H1 stamp , it is advisable tyo travel on H1 , if you have not received your EAD.

Actually, I have valid H1 status (of course no valid
H1 visa after years in US). Got RFE on EAD so don\'t
expect to get it soon.

I heard Third contry visa application (in Mexico or
Canada) was no longer available, and apply H1 visa
in my home country could be risky. So I wonder if
AP helps.

My lawyer also said it\'s OK to enter with AP but work
with H1. But I want to be sure because she messed up
my EAD application which causes the RFE.

Is there anybody who reenter US without EAD? Did border
officer ever ask for EAD? Thanks in advance.
 
AFAIK, EAD got nothing to do with travel

My lawyer told me that I can travel as long as I have a valid H1 and 485 receipt or AP.

Whether you have EAD or not doesn\'t matter.

Hi Arch,

Are you sure you can travel with only 485 receipt but not
AP? I got a friend who can not come back because she only
has 485 receipt but no AP. According to INS, if you
travel abroad without AP while AOS is pending, your 485
will be denied. I don\'t know whether that\'s true if
you have valid H1 visa stamp. So I have to be very careful...
 
Man, EAD not valid for re-entry to the us

if you have AP just use it for travel if you do not have valid H1 stamp
 
I don\'t understand why EAD has anything to do with reentry of US.

I think you can use it to work leagally if your H1 has expired.
You can use AP to reenter the US if your I485 is pending
 
AP is the standalone travel document

My lawyer told me this, I only need AP along with my passport.
But he also mentioned I bring EAD if I have one
