travel while H1 extension is pending

Gurus,

I hear contradictory statements from people about leaving the country (visit India) while H1 extension is pending and current H1 is still valid.
To be precise, my current H1 is valid till 01/01/04. H1 extension is applied on 08/04/03 (my co doesn't do premium process). Now I plan to visit India in the second half of Nov '03 and return in the 1'st week of Dec '03.

Do anyone see any problem with this.

The primary confusion is about the I94. All you need to do is to file I102 at the local office after the h1 extension approval and get a new I94.
If there was a change of status , then travel outside USA will abondon that petition. H1 extension is one of the exempt situations.
