Hi,

My friend situation as follows.

His and his wife Visa (H4) expires on SEP 2003.

He applied for her GC (all I140, I485, I765, I131 pending), but it was denied. so he appeled ....

Now situation,

My friend's wife planned to go india, so when she suppose to come back ? . (1 month before her expires date, is this OK ?).

if her AP approved in mean time ... can she use her AP at any time (while returning from india)?

I greatly appreciate any inputs on her situation ....

---- She should come back on H4 before the H4 expiry date and your friend should maintain H1B, because appeal will take time and if appeal is also denied he will have status to remain in US

------- If I-485 is denied she maynot get AP and if by mistake gets AP she should not use AP as AP was the base of pending I-485 and that is denied

What was the reason for I-485 denial?
What is the service center? When did he file I-485? If you post the info it will help others
 
My wife used H4 Visa to re-enter the country on 7/30/2002 at Atlanta POE which was supposed to expire on 8/14/2002, while coming from India.

Even though she and my daughter had approved AP.

I will suggest not to leave the country until your friend get approved AP. Because of denial of other application.

Thanks guys,

His I140 got denied .... INS did look at I485 atall .....


He applied in EB1 category at TSC ... He said INS raised issues about several issues including his name , publications etc ...
