Hello,

My H1-B visa expiration date on my passport is May'14'2003.

I am planning to go to India on March 12 and come back by March 25th. Would that be an issue? If not, do I need to carry any other documents just in case to be safe.

Please advise.

Thanks..BVReddy

You can do so without any problem. However carry the new H1B
approval notice, and make sure, the INS officer at the port of entry enters the expiry date of the new H1B, on the I-94 stub.

Once you are back in US, you may want to get the new stamping
by sending the paperwork to Department of State, St.Louis.

My company hasn't applied for the renewal. They are going to apply in 4th week of March and do premium processing.

Would really make sense to carry atleast
the receipt notice for your H-1B application.

I could get back in to the country with one
week left on my visa but had the receipt
notice and all other relevant paper work
like employment verification, purpose
of visit outside the country....and all. When I
mean all, carry all immigration documents
that you have like I-20, OPT (if u were a
student here)... tax filings for the previous years. Sounds like I am paranoid
but believe me you never know what the INS
officer may ask you for.

I am planning to take

1. Employment Letter from my company.
2. Letter from Client stating I am employed (contractor) up to Sep 30th'2003.
3. My employer said he is going to give me H1-B renewal Receipt Number as they are planning to apply on March,10th '2003. They will send the receipt number in mail to me to my India Address.
4. Tax Documents
5. All my H1-B visa related paperwork.
6. I am currently working in Federal Govt. as a contractor. I have some letters of appreciations, I will carry those.

Let me know If I need to carry any other documents.

Thanks..BVReddy

whatever you do..dont

ever go out of the country when your H1 is pending period. you will get into so many I-94 mismatch issues which will touble you to no end.
get the premium processing done NOW. get the new H1 aproval notice get it stamped in India..it is really easy if you always have been in status..it got it done twice ..so did my wife...no questions asked...using the drop box.
