Travel to India with AP and without EAD

I would like seek opinion for below situation:

Our EAD expired end on Oct, 2003.

Our (me and my wife's) renewal for EAD was approved on Aug 13th, 2003 but cards mailded from INS didn't reach us. However Advance Parole documents reached us and is good until August 2004.


1. Is it ok to have just the approval notice OR we need EAD cards to consider EAD extension valid ?

2. Can we travel to India for a month starting Dec 27th 2003, since we have valid advance parole, even though we don't have current EAD cards ?


Our attorney has filed fresh set of application for EAD renewal (on Oct 22, 2003) but this new application yet to be approved.


3. Are we in OK status for working in US ? Logically I feel yes, since our earlier renewal application was approved on Aug 13, 2003.

Please let me know your opinion for the above.

EAD is not a travel document, AP is. Why do you think you need to show employment authorization at a port of entry?

However you need a valid EAD to work or continue to work. Yoour status remains legal even after EAD expiration as long as you do not seek employment without a valid EAD.

Yes it is Okay to travel without valid EAD. I was in similar situation and I asked my lawyer he said same thing. You can tracel with valid AP without EAD in hand..
