Hi,

I am a green card holder living in the US now eligible to apply for US citizenship, but will be travelling with my kid to India and stay there for 5 months and then come back and file the application for US citizenship. Will this 5 months stay in India affect my US citizenship application in any way, such as interview process, justification on why I stayed in India for 5 months etc. Please advise.

Thanks,
Ann

A single 5 month stay outside the US before applying does not preclude you from naturalization unless you return to a different district area when you return, or your trip show signs that you indented to break US residency ties (by changing your permanent address to India and/or starting working in India).

My wife was in India for 11 months before her application and she did not have any issues in the interview. However we filed taxes for every year and I stayed in the US during that time and her name was also on the mortgage. We had sent a copy of the mortgage with the N-400 application so they did not ask any questions during the interview....
