Travel Question..Nervous...

Folks,

I have a valid H1B expiring soon and is in the process of filing for an extention to 8th year! My 485 is pending for more than 16 months now. Me & my wife both have EADs. I am working on H1 while my wife is working on EAD. I have filed H4 extension for her too. My question is:

We both do not have Advance parole. If I need to travel to India, can I still use my H1B and enter back (by getting a stamping in India)? Even though my wife has worked on EAD, can she still enter back if she gets a H4 stamping in India??? Since I am too close (hopefully), I am wrecking my brains should I file for Advance parole???. It will cost $650 if I go through the Attorney!

You can return in H1B status but your wife cannot. She needs advance parole. AP can be file without an attorney. It is pretty straight forward.
