Our I-485 has been pending for 23 months. Now my wife has to travel to the UK using AP which will expire in MAY04.

My guess is, on her return to the US at SFO, her I-94 will probably be stamped with the expiry date of the AP, which is 30MAY04.

So what is the significance of the I-94 in this scenario. Do we need to do anything after 30MAY04 to retain our legal status in this country.

Thanks in advance for any comments on this question.

bql-csc,

I-94 is no biggie as far as AOS applicants are concerned. As an adjustee, there is nothing else that you need to justify your status.

The I-94 will be stamped till expiry of AP but that is just a formality. Bitterman (another senior member) actually went to CSC to get a new I-94 at some point of time in the past, but they laughed at him and threw him out. So don't sweat it, and enjoy the trip.

Good luck!

do't worry about it. at sfo they will stamp I94 for one year though the date is irrevalent to you since you are under AOS.
