Travel on OPT

I got my visa transfered from H4 to F1 while i was in US. Now I have completed my graduation and have an OPT and doing an internship with a company till April 04.

I am planning India trip in March and will have to go to US consulate in India to get my latest visa (F-1) stamped.

My question is what are the chances of rejection of my visa. I do have an offer letter from the company where I am doing my internship which states that I am an intern till April 04.

Any feedback or thoughts will be appreciated.

If you completed your studies and are on PT only without valid US vida, it's better if you go for H1 Stamping and not F-1. F1 Practical Card is not good to reenter but it is still considered part of your F-1 program. Going to the consulate only on the basis of PT is not 100% guarantee for the Visa. Take good documentation. All the best.

Kapil 101,

I didn't get your point, can you be more elaborate

I do have a valid approval of F-1 visa. But since I got the approval (from H4 to F1) while I was in US, I don't have a visa stamped.

I understand you point that H1 is the safest bet, but right now the company I am interning with is not ready to do my H1, because they are still not sure if they want to offer me a full time job or now. But they are OK if I am intern with them till April.

Any comments

When does your OPT and I-20 expire? Chances of rejection are high. If your OPT expires in April, then you would want a visa for 1 month, and that too an F1 visa, and too while on OPT. You must be kidding.

My I-20 expires sometime in next year and OPT expires n 31st Dec 04. (It just started lastweek). So I have enough time leftover on OPT if i visit India in March. My internship offer letter is till April.

Thanks for your help in advance.

My knowledge of F1 issues is that of the pre-SEVIS era and not up to date. If you are able to show strong ties to home country and your job offer is extended, then you could get the visa. Quite risky though. I would guess less than 50% Better strategy is to convince your employer to go for an H1. My feeling is that once your emloyer gets to know you, you might get an extension of your job. At that time explain to your boss you need to travel and cant get back unless you get an H1.
