I am currently working on an EAD while my spouse is in the 7th year H1 extention. As a result of the H1 extention, I have converted from H1 - H4. So my current status is - H4 working on EAD.

If I travel outside the country, would I need to get my H4 stamping done, to re-enter US? Or can I use my AP papers? What are the pros and cons of doing either?

Is it legal to get the H4 stamping done, while working on EAD? Would this pose a problem at the port of entry, when I try to get back into the country?

Pl advice.

Thanks!!!

This is a frequent question asked by H4 working with EAD and extending their H4 with the principal H1 every time. If you work with H4, you are not H4 any more and your status will be changed to AOS. If you extend your H4 has no meaning at all and you just waste application fee without any benefit. If you travel without AP you will not be allowed to re enter even if the H4 visa is not expired. The only way to go and return is to have a valid AP.
