Travel on H1B or Advance Parole(AP)?

Hello everyone,

I am on H1B visa and which is valid till May/2008 and about to file for AP (along with I-140 and I-485 together).

I am not sure as what is the best decision if I plan to travel India in Dec'07/Jan'8 time frame.

Would it be advisable to not file AP and travel on H1B because there is guarantee of getting AP before Dec'07/Jan'08

OR

Its safe to travel on AP and I would get my AP before Dec'07/Jan'08, if I file(I-140 & I-485) in 1st week of Sept?


Please, advise me.

Either way, u can travel with ur AP or H1B. I think with the new fee for I-485, u get AP and EAD. Am not really sure about that thou.

no you will not get AP and EAD with the new I-485 fee which is $1010 (ONLY INCLUDES BIOMETRICS) AP new fee is around $300 just by itself.

Please check out this link - if you applied for I485 and payed the updated fees, you already payed for EAD and Advanced Parole.

H1b is dual intent (for both immigration and non -immigration). You can travel on either your valid stamped H1 visa or AP.
