Travel on AP after Employer Change ...

Hi all,

1. My husband and I have EAD and AP, pending I-485.

2. Around 18 months after his I-140 was approved my husband changed his employer around Oct., 2006.

3. He filed a letter under AC 21, around end of December 2006, with employment verification letter and paystubs.

4. We have an AP from March, 2006 (then he was yet working with his old employer, the one who had filed for his green card) which expires March, 28 2007.

5. He used this AP to travel to India in April, 2006 and then again in July, 2006.

6. We are planning a 2 week trip in the 2nd half of February. Do you think there would be any issues:
-any issues due to change of employer;
-AP would have a 3 week validity from the date of entry in the US, though we have EAD valid till 2008;
-third trip on the same AP.

We would appreciate any thoughts, experiences etc. you can share.

Not sure about the first point as my case is marriage based. As far as the second two:

-The last time I returned it was on the final day of validity of the AP. No problem.
-As long as your AP is for multiple trips, which most are I believe, then you can make as many trips as you like. I made at least three of the last AP.

AP has nothing whatsoever to do with employment, so changing jobs cannot affect it. The only requirement is that the underlying I-485 application must still be pending.
