Travel - H1B stamp (old) + New employer

I have a H1B stamped in my passport from my current employer and is valid until Sep'07.

Recently, I accepted new offer from another employer and have an approved I-797 from future employer (validity from May'2007-May'2010). I have resigned from my current employer as of 1 June 2007, and my last day at current employer is on 15 June 2007.

Main question - I have plans to go to India before I start my new employment possibly on 18June, 2007. Do you think I can come back in US based on existing visa stamped on my passport from current employer OR it is mandatory to seek new visa stamp on my passport of future employer.

Please respond if any one was in the same situation. Unfortunately, there are no dates available right now and I don't now how to proceed.

u can happyly come back to US with old visa on it but do not forget to carry new H1b approval notices with you.You should show both if necessary asked by immigration officer.

OR it is mandatory to seek new visa stamp on my passport of future employer.
----------------at POE show valid visa stamp that has previous employer name AND Latest H1 approval notice and you will get I-94 till latest H1 approval notice (keep the new employer latter and show ONLY if asked)

New H1 B

Hi aamchimumbai,

I had the same problem and I came back from India with my old employer's visa. AT POE, the officer asked me if I am still with that employer. I said no and I showed the new employer's approved I-797 and it was not at all a problem. So, you are fine, as long as your Visa is valid.
