Travel during L1 Extension

Hi

I wud like to travel with my wife and kid to India to attend my sister's marriage during Jan '04 end. Our visa extension has been filed by my company.

Is it possible to travel to India on a vacation when L1 extension has been filed? (I am on L1 and my wie and kid are on dependent L2 visa)...

If not me can atleast they travel... and come back to US to join me by getting their stamping done in India (without my personnel apperance for their stamping).

How long would the total process take .. since my L1 extension has been filed on Dec 4th 2003 only.....
 
Hi,

You can travel during L1 extension process but coming back to US requires valid L1 extension approval and new visa stamp( if earlier one is expired). At Port of Entry valid visa and valid petions (L1 or H1) are required. Same thing applies to L2.

Your wife and kid can visit to India but coming back requires valid visa for which US embassy requires valid and original L1 papers.

As far as the processing times are concerned you can find out the details from this web site. Processing time may vary with the service centers .

I think primary applicants (L1 or H1)should not travel outside of US when their application (any type) is pending with BCIS.

You don't get the visa stamp at the port of entry, only at the consulate. You need an appointment (at least in Germany) and processing times are 5 - 10 business days, plus mailing (again, in Germany).

My children are currently stuck in Germany, because at their appointment the officer couldn't find a space to stamp the visa. Now we need to submit all kinds of new papers (proof that they are still going to school here, even though they are absent due to this delay in visa processing)

So, if they can stay a couple of weeks, and go to the consulate right after arrival, that would probably be best.
