Travel during consular processing

Dear experts,

In case of a family emergency can you get a travel permission while you wait for your interview date? Thanks!
 
Travel Permission from whom?

I don't think you need travel permission from INS or NVC.

you need valid Visa to travel as they don't give any travel document in case of CP (like AP in 485).

You your Visa is expired .. you will need to get it stamped while coming back.

If you hapeen to be in any other visa category other than H while waiting for CP, then getting a new non-immigrant visa (NIV) stamp can be problematic. Apart from the H (as far as I'm aware), other NIV categories require that you have a non-immigrant intent. Since you're waiting for your immigrant visa interview, and have applied for immigrant benefits, you've declared an immigrant intent to the United States government. This can be grounds for rejection of a NIV application. The H visa allows a "dual intent," so, in my understanding, having declared an immigrant intent is not an issue.

If you have are in a non-H NIV category, and want to be absolutely certain to be able to travel while awaiting permanent residency, and do not have a valid NIV stamp in your passport, then 485 is a more cautious route.

In my case, I am in the R category -- and my NIV visa stamp expired last year, well before my immigrant case was approved. I decided to take a risk and file for CP -- and so far it's bee alright. Like everything else, one looks at the different factors, and makes a decision based on one's circumstances.
