I was granted Asylum on Nov 2004 by Immigration Judge. I haven't received my I-94 or EAD as my background check is still pending.

Now can I apply for a RTD and travel on it even though I don't have my I-94 would I have any problems when coming back to the US.

Any suggestions.

I don't know much about immigration law, however I can guess that it will be risky to travel without the I-94. If you don't have the I-94 stating your approval asylee's status, you can't apply for RTD. Contact Gilbert or wantmyccnow.
 
Freedoms12 is correct.

I is not advisable that you travel outside of the USA until you have been approved. From your description, it seems that you are under the 'Recommended Approval' status. This means that you will be approved pending a clean background check.

Having said this, technically you are not 100% approved and must wait until CIS sends you the final 'Approved' letter. You can then take this letter and get an I-94, travel document, etc.

Thanks for the reply guys. Any idea how long does it take to get a background cleareance done and is the check done domestic or intl. It has been over 4 months and still nothing.

I hate to disappoint you, but I have known some background checks that have taken more than 1 year to complete.

As for what they check - I believe they check/verify your entire background including international locations.

My only advice is for you to keep inquiring every few months.
 
if you do not have the granted asylum letter with the I 94 you can not apply for RTD you have to send the asylum aproval with the application
 
I was granted asylum through Immigration Judge and I do have a letter issued by the judge stating that Asylum has been granted and appeals have been waived by both parties. Based on that I received my unrestricted SSN.

My question to you guys is this when you travel using your RTD do you use your I-94 also which was issued to you at the time of asylum approval.

When I was an asylee, I traveled only with my RTD and the visa inside it. I did not have an I-94. If you have the decision letter from the Judge or IO, take it with you. Good luck
 
1-94

looking at your dates, you are not eligible to apply for a RTD until November 2005, one yr after you were granted asylum. November 2005 plus the projected 5 moths before it is issued puts you to April 2006. My guess is that by that time, you would have been issued an 1-94

Everybody is eligible for a RTD upon formally being granted asylum.

No.That's not true.I was grantes asylum May,5 2004 and I just filled I-131 and received a reciept with reciept date February,28.
 
Mistake

I think AugAsylee might be thinking of I-485 that asylees can't file until after a year from the date of Asylum approval. But All asylees are eligible to file for RTD as soon as they recieve asylum approval.

Sorry. I meant that u were right. Everybody is eligible since the asylum status was granted.It was a response to augustasylee.

But I have a problem. When I did attempt to file electronically. I was asked the following questions:

I-131 Questions
In order to electronically process your application, you must provide information for the items
marked * below.
1. Is there a pending I-485 Application to Register for Permanent Residence by the beneficiary? *
Yes No

2. Has the beneficiary been granted Temporary Protected Status? *
Yes No

3. Does the beneficiary have an I-551 Permanent Resident Card? *
Yes No




When I responded in the NEGATIVE I got the following message:

Error

You cannot file an I-131 form. Please contact your nearest immigration office.
To exit the E-Filing Application and return to the BCIS Form page, select Continue.

Did you check the box for a Refugee Travel Document or a Permit to Reenter?

You can just file a paper application.

Although one can apply for an RTD upon granting of Asylum status.... traveling before your 1 year aniversay in the USA brings up another issue.

ONE YEAR continuous residency. Traveling outside right after one gets his/her asylum status might interfere with the I-485 application. Now I may be wrong, but I recall that asylees had to be continously present in the USA for one full year after getting asylum to be eligible to apply for adjustment of status.

Having said that - wouldn't traveling abroad for a few weeks or even months interrupt that continous requirement?

I always advise people to stay put for 1 year after getting their approval and applying immediately for their I-485. Once you have the reciept in your hand, then you can travel all you like. With CIS it is better to be safe than sorry.
 
It is one year in the aggregate. So if you went to Europe for one week then you can apply for adjustment one year and one week after being granted asylum.
 
So is it advisable to travel before your 1st Aniversary of asylum or should wait until the 1st year passes. The RTD what is their vailidity and can you use it for multiple trips until its validity. Now as you hold a RTD so what is your nationality I mean do they have a column saying citizen of or nationality.
 
I received my RTD today. I applied on Oct.28.2004. It takes 5 months to receive it.

It is valid for one year.

Refugee Travel Documents (RTDs) are vaild for 1 year, and Re-Entry Permits (issued to PRs) are valid for 2 years. They both use the same green booklet that says US Travel Document on the cover. The inside of the booklet dictates whether its an RTD or a Re-Entry Permit.

Yes, you can use it for multiple travels as long as the RTD is valid. There is a section there that lists your nationality/country of citizenship. There is also a section that indicates your currect status - i.e. Asylee or Permanent Resident.
