I have a problem with travel, which I don't think is unique, but for some reason I could not find any posts on it so I am posting this new thread.
My H1-B visa expires on 12/24/2004. My company has applied for Work Permit Renewal which has not come yet. The expected date for that application to be approved is 1/15/2004. I want to go to India now if possible for personal reasons.
If I go to India and return, say on 12/10/2004, would I be denied entry because my visa is valid only till 12/24/2004 ??? I would be carrying my renewal documents with me.
I am thinking legally he has to allow me in, but on my I-94 he will put a date of 12/24/2004, after which date I would be out of status, but when my work permit renewal gets approved I will get a new I-94 so I would be ok.
The only question is that can he deny me entry on 12/10 thinking that it is too close to my Visa expiry date which is 12/24.
Any help will be greatly appreciated.
