Travel Before H1 Validity starts (F1 to H1) ,while on OPT

Could any one had the same/similar situation ?

Right now i am on OPT working for a company ,Transfered H1 from F1. H1 starts from Dec31, 2004..need to travel on Dec 15h ...so my question is can i travel to India and get H1 stampped ?
 
Yes, I'm in a similar situation, my H-1 starts on the 21st dec and i want to go to India on the 20th. Is it possible to go? is it possible to go and not have the H-1 stamped in this trip and instead do it next time?

well you can always leave US any time you want but you have to keep in mind that you MUST have a VALID US visa in your passport for the status you are re-entering the US. That means, if you have not already a stamped visa, you will need to get it from a consulate before you return to US again. just I797/h-1 approval will not let you get in. and also rememeber that once your h-1 got approved, you lost your F-1 status right away regardles of whether you have used H-1 or not yet.

Thank you for ur reply. Just one more Q. Is it possible that i leave this county on OPT , as my H-1 wil start the day i am leaving this country and return as H-1? Also, do i have to show my paystubs after my H-1 has started, for stamping of H-1, or any paystubs will do?

Hi,

I am being troubled by my consultant not to go to India. They are giving me some reasons saying that I will be having problems while getting my H1 stamped and stuff like that. I have all my documents perfect. All my documents are valid and arent expired. Please tell me whether there is going to be a problem if I go to India after working for 6 months. They tell me that LCA and W2 would nt match and thats why they want me to work for one year and then go home.

Please help me and let me know what i should do.

well thats a typical desi consultants problem...buddy dont worry...if you have all your paper work ready and legal...then you can always go to a conulate to get your visa stamped. Desi conutants firms (or our lords) try to scare us by these tachniques so that they dont loose money they are getting from you when u r working...
Remember" working for a desi consutlant firm is like working for a circus...all consultants are like circus animals...circus lords make money as long as the animals are healthy and can perform in the show...and every day is a show!! so use your brain if a circus animal (desi consultant) asks his desi lord for a leave, the lord sees this leave as a loss in profit and does not look at the animals (oops i mean consultants ) problems...so he will try to scare teh animal so that he can run his show for some mroe time.....
indian consulting firms have now replaced the slavery we read in american history!!!
 
well, i'm working for a desi consultancy too, but my employer is not creating any of those problems. I just wanted to know about the paystubs..plzz someone help me. Do we need any paystubs while getting our H-1 stamped or do we need paystubs after H-1 has started?

Just take them with you if you have. It might help. I am not sure about these things. It is just a suggestion. Good luck.
 
No, WHAT I WANT TO ASK IS..WHICH PAYSTUBS ARE NEEDED FOR STAMPING BASIS? the Paystubs after H-1 starts or before, coz i wont have any paystubs after my H-1 has started as i want to go to India that time and wont be getting paid!! Only after i come back will i be getting paid!

just use comon sense...what every one is trying to tell you is that JUST CARRY THOSE PAYSTUBS wherever and what ever you have along with you when you go for stamping!!!!!!! I am sure they dont weigh in tons...does it bother you to carry a years paystubs which wont be more than 26 or 12 (depending on how often u get paid) and wont weigh more than few 1/2 pound....
 
hmm..my common sense is still asking me a Q. If pay stubs after my H-1 has started are required, then i wont be able to stamp my H-1 , understand my Q? Its not about carrying how manyever paystubs..its about carrying which paystubs? Do i even ahve the paystubs that they require is my Q!! As aftet i go to india, my h-1 will start and so i have only paystubs prior to my H-1. Are they good enuf for geting it stamped?
 
Ok I would still say that you use common sense here :) If your h1 has not started or justtttttt started...then ofourse it means you have not started working yet on H-1..which offcourse means that you dont have paystub ...and If the people in US consululte have what you dont ( u know what I am talking baout.. ans: common sense ) then they wont ask you for paystubs :)....I hope it helps :)
 
Well , i believe u have lot of common sense, which is usually hard to find. Well if u think u have it..good for u..! but u r so totally missing the point. Thx anywaz..
 
ok ok ...to be more specific,,,,i dont think its problem...paystubs are required only for those who already are working on h1..they are not required for someone who has just started OR is about to start working on h1...

I have put that down in my note book :) I was not trying to be rude or mock at your questions..just putting in some spice in the discussions while we help each other..u know the desi style...we pull each others legs all the time..not with bad attantions but for the sake of funnnn...sorry i f u got ofended...
