Hi All,
My husband is working for company A. Due to an internal transfer and change in the job description, the HR filed for a new H1(amendment) in Dec 2010. However we have plans to travel to India in April 2011. His current H1 is valid till aug2011.

Can he travel to India on his old H1(visa stamped which is valid till aug2011) along with the new H1 approval notice? or does he have to for sure get the new H1 stamped to get back to the US? The reason is that he would not want to take the risk of going for a visa stamping again after having a hard time being stuck for sometime in India the last time he went (for suspicious people..not everyone is lucky enough and he works for an aircraft company, so the risk is high!). Please help!! Any help would be greatly appreciated.

if his passport has Valid H1 visa stamp till August 2011 and he has got H1 amendment approval notice then he can enter US with valid Visa stamp BEFORE August 2011 AND at POE he must show the Valid Visa in Passport and new H1 approval notice so that he can get I-94 till his latest H1 approval Notice.
FYI at this time all the US consulates are asking many documents and many H1 or H4 are getting 221g and being rejected.
For more info your spouse should check with his company lawyer.
