Transit Visa???

Folks,
Need some one to help me with this.

I have my tickets book to go to india on dec 28th, i was going via London and they did not need a transit visa if you have a valid h1b visa stamped in ur passport which i do have.

Got my approval y'day and will be getting it stamp before i leave, US consulate website says that if you have green card then you do not need a transit visa but does not sy anythng about ADIT stamp, my understanding is that u will need a transit visa if you have just and ADIT on ur passport, am i correct?

other option is to go via France as i heard they do not need any transit visa, is it correct?


would really appriciate if some one can share there exp and thought.

greencards(not stamped passport i beleive) issued after i beleive after 1998 neednot require transit visa..

I don't know about needing transit visa with stamp or with green card. But I do know that you need a transit visa when you go thru France if u dont have valid US visa stamp. I went a couple of years ago and did not have a valid US visa stamp (just had approval, got stamped in india). I had to get a French transit visa from the consulate here.
 
If you have a valid H1 stamp. Just show them that. Dont even mention the ADIT approval stamp etc. Better not to confuse them.

Save up on the trouble of a transit visa.

If i get ADIT stamp on passport, they will cancel h1b right there, am i missing something here.

Have a look onumber 3 which is in bold, IS IT SME AS GETTING A STAMP ON PASSPORT OR IS IT THE REAL GREEN CARD?

you need a Direct Airside Transit (DAT) visa, unless you qualify for exemption because you hold one of the following:

1.a valid visa for entry to Canada or the USA and, regardless of the routing you choose, your ticketing includes a visit to Canada or the USA;

2.a valid airline ticket for travel via the United Kingdom as part of a journey from Canada or the United States of America to another country or territory, providing that you do not seek to transit the United Kingdom on a date more than six months from the date on which you last entered Canada or the USA with a valid visa;

3.a US I - 551 Permanent Residence Card (Green Card) issued on or after 21 April 1998;
4. a US Immigrant Visa and Alien Registration - Form 155

5.an expired I - 551 Permanent Residence Card and a valid letter authorising its extension from a US Embassy/Consulate;

6.a Canadian Permanent Residence Card issued on or after 28 June 2002;
7.a valid Category D visa issued by EU/EEA member states;
8.a common format EU residence permit issued under Council Regulation (EC) No 1030/2002.

This refers to the real green card, issued after April 1998. Temp I-551 stamp is not acceptable by UK authorities.
If you have a valid H or any other US visa it is also acceptable instead of a UK transit visa.

nkm, thanks for clarifying this, tell me something, may be i am missing something here vikir also mentioned something similar.

When i will go for stamping, wouldn' they cancel h1b stamp on my passport?

I think i am going wrong somewhere.
 
dear friend, i guess your h1 would no longer hold valid once you get your green card stamped on passport..but the sentence below from your post "4. a US Immigrant Visa and Alien Registration - Form 155
" gives some hope that even green card stamped in passport "May" hold good..since your h1 validity would be nullified by GC stamp.try to contact the uk embassy at dc/Ny..or i guess your travel agent also maybe experienced enough to provide info on this..

Devotee, thanks for ur response man, that's what I think, I tried to call uk emabassy few times but there phone system is so scrwed up i t made me wait every time and then said it can not transfer me to operator....god knows what is wrong :D :D :D

Yes, the H1b is cancelled. But on your passport the H1B stamp is still valid. They will only look at the valid H1b on the passport. They do not have a way to look at the validity of the h1b. If they did they could see that you have a approved green card. Hence if the the h1b on the passport is physically valid (even though, technically it isnt). Just use the same for it. Also, the transit visa is typically only checked by the airline personnell and not by any immigration authorities. They only look at the pages you point out to them. That is what I was saying.

vipir are u sure? I though whe u go for ADIt stamping, they put a big red cross on u r h1b stamp, just like how they do when u get ur new h1b visa stamp.

any one who did stamping can verify this, any one out there, u vipir? did u do stamping?
