Transit visa response from UK consulate

Dear xyz,

Thank you for your email.

As your US visa will be cancelled and your actual Green Card will not ready for a period of time. You must apply for a UK Transit Visa.

It looks like some things have changed in the last one year.

When I came back the first week of June , 2003 the earlier H1 was cancelled in my Passport and what I carried was just the Visa stapled to the outside
of the packet. I did not even attempt to get a transit visa from UK.

I or my family did not have any problem at the Heathrow airport.

That is because you had a valid visa (stapled to the packet). If one has a valid visa to US or Canada, a transit visa is not required. GC temporary stamp is not considered by UK authorities as a valid visa.

Upon finishing the interview on the way back, do you need transit visa for UK.

I know why I did not have to get a transit visa at that time!

I was responding to the 'email response from the UK Visa section' posted
above.

The question is, whether showing VISA approval is sufficient or not?

I am not sure what you mean by showing "visa approval", you either have a valid visa to US (H1, B2, etc. or immigrant visa) or you don't. If you have a valid visa you are NOT required to obtain a transit visa for UK. If you don't have a valid visa, (even if you have a temp GC stamp) you are required to obtain a transit visa.

I do not want the readers to be confused about this whole exchange!

If you look at the very first post in this thread, the member said he has
sent a mail to the UK Visa section asking them "whether he can transit through UK with the Green card papers (the visa packet + approval )?'
The following is the actual sentence he has put,

"This was in response to my query sent to them saying that I will have my greencard docs on my way return to USA".

Now, look at their response. Their response seems to indicate that even
though one has the above papers, he/she needs to get the transit visa.
What I said in my post was, my experience was different.

I am sure, like me, scores of candidates have passed through UK with just IMMIGRANT VISA APPROVAL + PACKET and ALL OTHER VISAS CANCELLED IN THEIR PASSPORTS.

Let us not even bring the other Non-immigrant visas into this discussion,
because, they are different. One cannot go through UK or for that matter
International Airport in India with just the visa approval . For these visas
getting the VISA stamp in the passport is mandatory!

I am still in dark as to what you mean by visa approval. Anyway UK authorities don't care whether you have the immigrant visa attached to an envelope or have a visa stamped to your passport. They only care for a valid visa to US. An immigrant visa IS a valid visa to US and there is no need to get a transit visa if one has an immigrant visa. The original poster confused the UK consulate by saying that he will get his greencard docs in the US. The question to them should have been "Is a US immigrant visa enough to transit in the UK without a transit visa?"

That is the actual visa, not approval notice. The title of that form is "IMMIGRANT VISA AND ALIEN REGISTRATION".

If you look at my very first response to 'uvwxyz' , you will see that I have
clearly stated "visa stapled to the outside of the packet".

Since the discussion was about Green Card, every candidate who attended
the IV interview would know what packet I was referring to, and I don't think
my post lead to any confusion.

It is only later on in the thread the discussion went to areas like H1, B1,
temporary GC stamp in the passports etc. All this was unnecessary and out of
context.

Later on in the discussion, I did use the word visa approval but always in
combination with 'the packet', so I knew what I was talking about, you know
what I am talking about and hopefully the original poster knows what I am
talking about. The form does say 'Immigrant Visa ......' at the top.

Anyway, I hope the whole thing helped 'uvwxyz' in someway. For his benefit
I still feel that after the interview, you don't need to get transit visa to go
through UK airports.

I have a question regarding onward journey from the US to India and the requirement for transit visa.

My situation is as follows:
The H1-B stamp on my PP is expired but I have the H1-B approval notice for the next 3 years or so. If I go to India thro UK, would I need a transit visa? I understand that I might need it by reading the UK consulate web pages. They say that we should send our approval notices in original.

How is your situation? Would you have a visa when you go from the US.

To others: Does anyone have experience sending their original H1 approval notice to any of the other embassies? Is there any country that does not require transit visa.


Any help will be appreciated.

you require a visa

In your case you definately require a transit visa, You can get one or fly through a country that does not require the transit visa

Its the consulate's web page

In my case I am going through a Saudi Arabia airline which goes from NYC to Jeddah and to Mumbai , I got the best deal and no hassle of transit visa..

Northwest/KLM will have the same convinence. though as an airline I'm not keen on flying it.
