Transit Visa not required for Advance Parole travelling through Frankfurt

Today I went to German Consulate in Chicago to get the Transit Visa since I am using the Advance Parole. They said I don't need a transit visa and gave me the document which is attached.

Be sure to take that note along with you during your trip. Just like US border patrol officers at times are ill informed about their own laws, the german border guys are not much different. In the past, different german consulates were giving out confusing information on this issue. With an actual letter in hand, you are in a better position if your airline doesn't want to take you aboard (fearing that they have to ship you back if you are denied transit entry).
 
Transit visa for AP holders travelling thru Frankfurt

That document clearly says AP is not sufficient for returning to the USA without an airport transit visa.
 
What is the conclusion here?

My wife will be going to India along with my daugther on Januray 8th and she will be using AP for her travel (Her H4 has expired and the new H4 Visa valid till March 2006..will be getting new H4 soon).

Do we need to get any transit visa at Frankfurt to go to India and to come back to USA?
She will be coming back by March 15th 2006.

Travelling through Frankfurt

Hi Ravisurya,

Myself, Mywife and daughter are all travelled through Frankfurt to India and did came back in the same way. My wife's and daughter's Visa was expired and they travelled using AP and H4 documents.

None of us went beyond the security and customes cleared area and travelled from US - Frankfurt - India in the same flight and halted at Frankfurt for the flight refuel only.

We travelled in the month of July / August and did not faced any problem.

I do not know if there is any change in the immigration and customs procedure between now and then.

On the way back .................US-Visa stamped in their passport...................................without an airport transit visa.
 
The way I understand it is that if you travel US-->germany-->india and you have an approved I129 with you, you DON'T need a transit visa. If you return india-->germany-->US, you need your valid H1b stamp in order to transit through germany (you can't transit through germany without a valid visa to enter the US).

Traveled by Air India using Advance Parole through Frankfurt and I didn't need transit visa.
 
just talked to AI chicago directly yesterday and they said it is needed

Guys, you only need transit visa if you have to clear customs and passport control, for instance, to stay overnight in a hotel. To walk from one gate to another you don't need no visas.
 
Why confusion

Guys why so much confusion here... it appears that the consulate would say yes or no randomly... for airport transit visa on Advanced Parole... as per my understanding The Airport transit visa is only needed if you lived illegally in US and need to go to India... If you are legal in US and can enter legally then NO transit Visa is required.


Any body here post please if they had problems without Airport Transit Visa and on Advanced Parole...

Who the hell would try to enter US without H1B stamped... what the hell would happen to U if you reached US by chance, forget about the German transit Visa.... you will be in big trouble...

Hello All,

I have travelled thru frankfurt many times, Nobody asked or checked visa's unless I was going thru Immigration, But I always had a valid H-1 Stamped in my passport.

Anyways,
I am asking the question here because,
I am actually going on vacation to Egypt and would be transiting thru Frankfurt. I am on an Advance Parole and my H-1 has expired (I have previously travelled on AP to Spain, but it was a direct flight from the US).

DOes anybody know or can shed light on whether I need a Transit visa.
Also if I do need one, any idea how long it takes to get one ??

I assume you mean to say that I donot need a Transit Visa.

I received an email from the German Consulate in NY stating that I donot need a visa.
But the exact wording is

Dear Sir,
if you are carrying an advance parole paper with you in Germany you are not required to have an airport transit visa on your flight to India.

I did email and clarify that I was not travelling to India , but to Egypt.

They then emailed me

Dear Sir,
in that case you are required to have an airport transit visa. Please refer to our website www.germanconsulate.org/newyork for all information on how to obtain the visa.

Travelling thru Frankfurt on AP

Just returned from a Trip and travelled using AP.
Flew Lufthansa and had to transit thru Frankfurt.

Here are the details on the Transit visa situation while travelling on a AP:

The Rule is that if you have an Advance Parole (Original Document) and are travelling to your home country (the important word here is HOME COUNTRY) then you don't need a Transit Visa to travel thru Frankfurt.

If you are travelling to and from a country other than your Home Country then you do need a Transit Visa.

The immigration agents meet you at the aircraft door and check passports as you disembark and they do check for Transit Visa's. They donot stamp anything but they do stop you and check Visa's.
