Transfter from H1B to H4

Hi, I came to US on H4. I got my H1B visa here in US. Now I got laid off a month ago. Now I want to change my H1B to H4. since our GC is under process and my spouse will be getting I-140 in another one months time.

1. How long does it take to transfer from H1 to H4.

2. What is My status while this transfer Process?

3. What status should I show on the 485 application, if my spouse get\'s I-140 and we have to file for 485.

4. What documents we need to produce to transfer from H4 to H1.

If anybody can answer this, that would be very Helpful!

Fastest way is reenter US with H4

If you still have a valid H4 visa in your passport, the fastest and easiest way is to get out of US and reenter with your H4 visa and copy of your spouse\'s H1 approval notice.

1. How long does it take to transfer from H1 to H4.

A)Anywhere between 2-6 months, it depends on INS and your luck

2. What is My status while this transfer Process?

A)If you are laid of recently that\'s fine , if you apply for H4 you are on H1 till your H4 approves.

3. What status should I show on the 485 application, if my spouse get\'s I-140 and we have to file for 485.

A)You should show say H1 status and pending COS to H4

4. What documents we need to produce to transfer from H4 to H1.

A) Do you mean H1 to H4 , you need all the regular stuff of your spouse H1 details, and your details, marriage certificate some times they may ask for pay stubs.

I am in the same Boat.

I just got my I140 approved. my wife came to US under H4 and got her H1. she got her H! stamped (H1) in INDIA when she went to INDIA. now she got layed off. IS it possible/advisable to go to CANADA to get her H4 stamped ? Gcneed, batliwala, sami02 any advise, Thanks
 
Some of options I see are

1)Well she can apply for COS from H1 to H4 which may take some time.
2)Yes she can go CANADA to get H4 stamp ( this would be quick).
