Transferring Mexican TN to New Employer

Do you guys know how long the process takes for a Mexican citizen to get a TN if it is a transfer to a different company as opposed to the first time it is being issued?

I currently have a TN but looking to capitalize on a great opportunity at a new company, but I'm not sure that a) this is possible b) what the process is like and c) how long the whole process would take

I've been reading several posts but most are Canadian-specific and the process seems to be slightly different for people from Mexico

Any help would be truly appreciated
 
You cannot transfer a TN to another company. What you can do is:

A) Go and get a new TN at the border for the new company and then start working for them.

B) Apply online or by mail with an I-129 for a change of employer. It will take about 1-3 months for this. If you pay for premium processing ($ 1,000 extra), it should take about 10 business days.

I'm not sure if there is anything else you need to do because your TN is from Mexico.

So do would the company have to do either A or B, or both?

Not really sure how point A works b/c when I fly into the US the people at customs don't really know much about TNs so I'd be afraid of leaving and trying to come back with a TN... So if it's either A or B that can be done... Option B is looking much better
 
I know exactly what you are saying about the people at the airport not knowing about the TN when you come back.

My suggestion would be that since you are in New England, you might want to make a weekend trip out of going to the Canadian Border and getting everything done there. The guys at CBP (Customs and Border Protection) do these all the time. What I would suggest is that you find the POE (Port of entry) that you want to go to, and you call them first. Get the name of the officer you are talking to and explain your situation. If they understand what you are trying to do, and you feel comfortable with them, then arrange it so that when you go there, they are available.

Do you know if there are any problems by filing a TN with a different company while you're on TN?

The thing about the Canadian border is that I'm not sure if that works for Mexican citizens. That's my only fear.

Basically, I don't want to be left out with no Visa while my second employer is trying to make one for me, but I don't know if there would be any conflict of interests if I'm on a TN and a different employer is applying for for me at the same time?
 
I forgot to tell you that you can have more than one TN at a time.

Where are located? What State? I'll send you the CBP number.
 
Really? More than one at the time? So they can overlap with no problems?!

I'm in Massachusetts... Would really appreciate if you can give me that info!

I talked to a lawyer today, they told me that I might not need to apply for the I-129 but just go to the consulate in Mexico and with the paperwork needed (letter of employment, credentials, etc) and they can give me a new stamp for my new employer. Hopefully that'll be the case!
 
The I-129 is just a form. It is used for an employer to request "petition" for an employee. It is used for many different work permits. If you are making a trip to Mexico, then going to the consulate might be your best bet. I believe some things are slightly different in Mexico than they are in Canada for the TN. We just go back and forth and get it stamped. But I believe you have to go to a U.S. consulate in Mexico - correct? So even if you went to the Canadian border, you would still have to get it stamped by the U.S. consulate or embassy in Canada - correct?
Are you planning a trip to Mexico? If so, then do it your way. If not then do it with the I-129 if you can wait -or pay the premium processing and it will be done in about two weeks.

Just to be clear, if I re-apply for the I-129 with my new employer... What is the next step to get the TN at my new potential-employer?

Or all I have to do is for them to file the I-129 and then once I have that I'm all set???

Sorry if these are silly questions... I'm completely unfamiliar with the process. Thanks again for your help

I'm a Canadian citizen this is my second year on TN-Visa working for company A consulting for client company B. Now I'm asked to join company B as a full-time employee. My question is that do I have to go to the border to get the new TN Visa? or Can I apply through mail? I know I can apply TN extension through mail if I'm working for company A. As have 2 small kids it is difficult to drive from soutn east of US to the nearest Canadian border. Do I have apply for new TD's for my wife and kids?

You can get new one at the border or by mail (mail will either cost $1300, or you will wait 4 months).

The family's TDs remain valid until their expiry date, as long as you have any TN. But at some point they will need to get a new TD, as theirs would expire before your new TN does.

I assume that when you renewed your TN for firm A, their TD were all renewed as well?
