Transferring from OPT to H4 in US itself

Hi,

I am having a bit complicated issue. I am on H1-B and I am planning to get married here in USA itself. My fiancee is on OPT right now and before her OPT expires in June, I want to get married and convert her status to H4 so she can stay here.

Is there any specific information how this works and how long does it take to convert the status for my spouse from opt to H4 here? Is there any specific document / information to this?

If anyone could reply to this, that would be great.

Hey Bhagat, you need to file a change of status (COS) application to H-4 before her OPT expires. She will be in valid status while her COS application is pending with the INS irrespective of whether her OPT expires.

You need to file Form I-539 and attach documents like your H-1B approval notice, copy of your passport, marriage certificate, photos etc to show a valid relationship.
