Transfering H4 visa

Hi,

I have got my h1 transfer today, but my company lawyer told me that there is no need for the transfer for my wife and kid. Is it true? So now what will happen to my wife's and kids visa? Will it be a problem is they go to India and come.

Hello,

You should get the H4 visa for yourwife and kid right away. Has their H4 visa already expired along with your H1? or is your H1 with company A still valid? Are you still working with company A or joined company B

By all means you should not allow your wife and kid to be out of status, apply for their H4 right away and seek legal opinion for the lapse of period

If your H1 on company is no longer valid your wife and kid cannot return back to the US with a H4 from the previous H1 based employer.

Once again seek legal counselling and opinion and act expeditiously even if you need to apply for premium processing of H4 (if there is one)

Actually I have the visa validity till Sep 2008. So now I got transferred and for me it got approved. But that lawyer told me that you dont need to get the transfer for wife and kid.

I was bit confused regarding this, since he told me even though company A visa gets cancelled, it would not be a problem to go out of the country and come back.

------- H4 status is linked to your H1 status not with employer A or B, If your dependents have valid I-94 they are ok.
dont forget to file H4 extensions BEFORE the I-94 of H4 holders expires.
